What is IR35?

In government terms, IR35 (‘The off payroll working rules’, or “Inland Revenue 35”) ensure that workers, who would have been an employee if providing the services directly to the client, pay broadly the same Income Tax and National Insurance contributions as employees.

In simpler terms It’s a test of tax. If a worker operates through an intermediary considered a ‘personal service vehicle’, most commonly a Limited Company, then an IR35 status must be determined – either Inside IR35, or Outside IR35.

Inside – You’re considered an employee for tax purposes.

Outside – You’re considered a business for tax purposes.

why is IR35 Important?

IR35 is not only important due to tax liability (if you’re the responsible party, you may be liable for incorrect taxation due to your determination or non-compliance), there are numerous commercial impacts ranging from cost, through to attraction and retention of your contingent workers.
